SMS Program Terms & Consent

A2P 10DLC / TCPA / CTIA Messaging Terms. Applies to Fear1ess3-operated websites, forms, funnels, portals, applications, and communications. SMS DISCLOSURE: By affirmatively opting in, you agree to receive text messages from Fear1ess3 LLC at the mobile number you provide. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent to marketing texts is not a condition of purchase.
1. Program Description
Fear1ess3 LLC operates SMS and MMS messaging programs to communicate with prospects, customers, clients, and authorized users who have provided consent. Depending on the context and the consent provided, messages may include:
- Demo, consultation, and appointment confirmations and reminders
- Appointment rescheduling, missed-appointment, and follow-up messages
- Responses to inquiries and customer-support conversations
- Service-related notifications, account updates, onboarding, and operational communications
- Requested information about Fear1ess3 services
- Marketing or promotional messages, but only when the recipient has separately provided the level of consent required for those messages
Our messaging is intended to be permission-based, conversational, transactional, informational, and, where separately consented to, promotional. We do not use purchased, rented, scraped, or unlawfully obtained lists for SMS marketing.
2. How You Opt In
You may opt in through one or more clearly disclosed methods, including a website form, demo-request form, calendar or appointment form, application, checkout or onboarding flow, chat widget, QR-code flow, paper form, text-to-join keyword, or another documented consent method that we make available.
- When a web form is used, the SMS consent checkbox is not preselected and requires affirmative action.
- Providing a phone number by itself does not constitute consent to receive marketing SMS messages.
- Marketing and non-marketing/transactional SMS consent are collected separately when both message types are offered.
- SMS consent is optional. You may submit forms or purchase services without consenting to marketing text messages.
- By opting in, you represent that you are the subscriber or customary user of the number provided or otherwise authorized to provide consent for that number.
3. Marketing vs. Non-Marketing Messages
3.1 Marketing Messages
If you separately opt in to marketing messages, Fear1ess3 may send texts about offers, promotions, educational content, events, service updates, and related marketing communications. Consent to marketing texts is not a condition of purchasing any goods or services.
3.2 Non-Marketing / Transactional Messages
If you opt in to non-marketing messages, Fear1ess3 may send texts related to appointments, service requests, customer support, account activity, project updates, onboarding, reminders, confirmations, or other communications directly related to your relationship with us.
4. Message Frequency
Message frequency varies based on your interactions, appointments, requests, and the specific program you join. You may receive recurring messages. Transactional or support-related message frequency may temporarily increase as needed to respond to your request or manage an active appointment or service matter.
5. Message and Data Rates
Message and data rates may apply according to your wireless plan. Fear1ess3 does not charge a separate fee merely to receive our SMS messages, but your wireless carrier may charge you for SMS/MMS or data usage. Contact your carrier for details about your plan.
6. Opt Out — STOP
You may revoke SMS consent at any time. Reply STOP to any message to opt out of messages covered by that consent. We may send one final confirmation text acknowledging the opt-out. After that confirmation, no further messages covered by the revoked consent will be sent unless you later provide new consent.
We will also honor other legally valid revocation requests made through reasonable methods as required by applicable law. Additional recognized opt-out keywords may include END, QUIT, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT when supported by the messaging platform. Processing may take a reasonable period as permitted by law, although automated STOP requests are generally processed promptly.
7. Help — HELP
Reply HELP to a message for assistance. You may also contact Fear1ess3 LLC at info@fear1ess3.com or (972) 697-6682. Our HELP response may identify Fear1ess3 and provide support contact information and opt-out instructions.
8. Re-Enrollment
If you previously opted out, you may re-enroll only by taking a new affirmative opt-in action through an available consent method. Prior consent does not automatically restart after an opt-out.
9. Carrier Delivery and Availability
SMS/MMS delivery is subject to wireless carrier and network availability. Carriers are not liable for delayed or undelivered messages. Fear1ess3 does not guarantee delivery, timing, or receipt of any message. The program is intended for supported U.S. mobile numbers and participating carriers.
10. A2P 10DLC, TCPA, CTIA, and Carrier Compliance
Fear1ess3 intends to operate its messaging programs in accordance with applicable messaging laws and industry requirements, including the applicable provisions of the Telephone Consumer Protection Act (TCPA), FCC rules, CTIA messaging principles and best practices, A2P 10DLC requirements, The Campaign Registry requirements, wireless carrier policies, and messaging provider rules. A2P registration or carrier vetting does not constitute an endorsement of Fear1ess3 by any carrier, registry, or governmental agency.
11. Consent Records and Compliance Evidence
We may maintain records reasonably necessary to document consent and messaging compliance, including the date and time of opt-in, the source or form used, the consent language displayed, the phone number, IP/device information where available, campaign or workflow identifiers, opt-out records, and related communication history. These records may be retained for legitimate business, compliance, audit, dispute, or legal purposes.
12. Privacy and Mobile Information
MOBILE INFORMATION NON-SHARING: No mobile information, phone number, text-message opt-in data, or SMS consent will be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes. Information may be disclosed to service providers or subcontractors only as reasonably necessary to operate and support the messaging program, including messaging, CRM, customer support, hosting, or telecommunications providers, subject to appropriate confidentiality and data protection obligations.
All other data-sharing categories described in our Privacy Policy exclude text-messaging originator opt-in data and consent except where disclosure is necessary to provide the messaging service, comply with law, protect rights or safety, or respond to a valid legal process. 13. Phone Number Reassignment and Accuracy
You agree to provide a valid mobile number and to notify us if you change, transfer, deactivate, or are no longer the subscriber or customary user of that number. If we learn that a number has been reassigned or is no longer associated with you, we may stop messaging that number.
14. Prohibited or Abusive Use
You may not use our forms, applications, or messaging channels to submit another person’s phone number without authorization, interfere with opt-out mechanisms, impersonate another person, or misuse the program. We may block or restrict abusive activity and may take steps required by carriers, providers, or law.
15. Changes to the SMS Program
We may modify these SMS Program Terms & Consent from time to time to reflect changes in our messaging practices, laws, carrier requirements, or platform rules. The current version will be posted publicly with a revised effective date. Material changes will be handled in accordance with applicable law, and new consent will be obtained when required by law.
16. Relationship to Other Terms
These SMS Program Terms & Consent supplement our Privacy Policy and Terms & Conditions. If there is a conflict regarding SMS consent, opt-out, or mobile data handling, these SMS Program Terms & Consent govern the SMS program to the extent permitted by law.
